VIRGINIA BEACH – Water leisure product company Aqua-Leisure Industries Inc. responded this week to a patent lawsuit from Virginia Beach-based SwimWays Corporation and said it will fight the allegations.
Aqua Leisure said in a release that its products use a wireless design, while SwimWays’ patents cover floats that use spring frames.
“Our designs are based on rigorous market research, which includes channel assessment, consumer insight, overall value, performance, quality and innovation,” Aqua-Leisure CEO Steve Berenson said in the release. “Aqua-Leisure has many of its own patents and/or patents pending in the United States Patent and Trademark Office, many of which counter the claims of SwimWays.”
SwimWays, in a complaint filed last week in U.S. District Court in Norfolk, listed products that it alleges Aqua Leisure and another company sell that constitute patent infringement.
