Woman sues Busch Gardens for $500K after fall in ‘Germany’ bathroom

A woman is suing Busch Gardens Williamsburg and its parent company, SeaWorld Parks & Entertainment, for $500,000 after she allegedly slipped and fell in a bathroom in the park’s Germany section.

Pennsylvania resident Annie Cavanah filed a lawsuit in April 2015 stating Busch Gardens was negligent because the park did not put a warning sign on a wet floor when she visited in August 2013, according to documents filed in the Williamsburg-James City County Circuit Court.

Court documents state the amusement park “carelessly, negligently and recklessly failed to inspect, clean and maintain the premises” where Cavanah fell.

“As a result of the negligence of the defendants, plaintiff was caused to suffer serious and permanent injuries; has suffered and will suffer in the future pain of body and mind; has incurred medical and related expenses; has been deprived of earning capacity,” documents state.

In a response to Cavanah’s complaint, Busch Gardens and Seaworld denied that no warning sign had been placed on the wet floor.

The defendant also denied the park is indebted to Cavanah in any amount.

“Defendant affirmatively asserts that plaintiff’s own negligence, in whole or in part, caused or contributed to the alleged incident at issue and plaintiff’s injuries, if any,” Busch Gardens and Seaworld’s attorney wrote in their response to Cavanah’s complaint.

The attorneys also added that if Cavanah’s injuries weren’t caused by her own negligence, then they were the result of other’s actions “over which defendant had no control.”

There are no future court hearings scheduled for the case, although the case is listed as active, according to online court records.
