The driver of a car that struck and killed a Newport News man riding his bicycle near Yorktown on Aug. 24 will not face charges from the incident.
Trooper Kenneth Palmer of the Virginia State Police said 27-year-old Nicholas J. Fisette of Panama City Beach, Fla., struck and killed 65-year-old Donald F. Brookshire on Cook Road at about 10:58 a.m. after Brookshire came off an access road onto Cook Road, directly into the path of Fisette’s Mini Cooper. Fisette did not have a chance to stop, as his line of sight was obscured by trees until it was too late for him to stop, Palmer said.
Brookshire was thrown 90 to 100 feet after he was struck, Palmer said. He wore a helmet and was still alive when emergency responders arrived minutes later. He was pronounced dead at Riverside Hospital in Newport News at 11:37 a.m.
Fisette’s Mini Cooper sustained $7,500 in damage from the incident. Palmer said there’s no reason to believe Fisette was speeding. Fisette told State Police he was traveling at 45 mph. Fisette stayed at the scene and was cooperative with police.
The car was traveling west on Cook Road, toward Yorktown. Virginia State Police Spokesperson Corinne Geller said Monday the incident occurred 0.8 miles east of Old York-Hampton Highway. State Police interviewed witnesses at the scene as part of their investigation.
Brookshire was riding a 2009 Alpha Trek 7200.
