
A trial for Stephanie Nicole Bozarth, a James City County woman who allegedly murdered her neighbor in 2011, was postponed today after a material witness who was supposed to travel here from out of state did not take a scheduled flight here.
“We made travel arrangements for this individual and were made aware that they did not get on the plane, so we know they were not going to be here today for trial,” said Williamsburg-James City County Commonwealth’s Attorney Nate Green. “With the absence of that material witness, we asked for and received the continuance.”
This is the third time the trial for Bozarth has been delayed. A Sept. 13 trial was continued to Dec. 13 after the court received a motion from the defense. That trial was continued to Wednesday after a witness from the prosecution was unavailable.
The two-day trial is now scheduled for Feb. 28 and March 1.
Bozarth allegedly murdered Tabitha Russell in August 2011 after a dispute with her. The trial will be held at Williamsburg-James City County Circuit Court.
