Evan Tyler, an 18-year-old York County teen accused of fatally shooting a Tabb High School student during an attempted robbery last year will serve 23 years in prison.
On Tuesday, York-Poquoson Circuit Court Judge Richard Rizk sentenced Tyler to 73 years in prison with 50 years suspended. The maximum penalty for all charges was originally set at 73 years and sentencing guidelines recommended about 14 years on the “low end” and about 24 years on the “high end” for time served.
In March, Tyler pleaded guilty to second-degree murder, attempted robbery, use of a firearm in the commission of a felony, shooting into an occupied dwelling and attempted statutory burglary while armed with a deadly weapon.
The charges stem from an incident that occurred in the Whispering Winds neighborhood in January 2015 during which Tyler attempted to rob Dylan Peters, 17, of drugs and money, court documents show. Tyler was a juvenile at the time of the crime, but was tried as an adult due to the severity of the charges.
Police said Tyler took a gun with him to Peters’ home and shot five .40 caliber bullets through a half-open door while Peters was on the other side. Peters, a Tabb High School student, was hit in the chest, shoulder, leg and hand. He died at Riverside Regional Medical Center in Newport News shortly after the shooting.
