A 17-year-old boy accused of shooting and killing a Tabb High School student in January will face a grand jury in July for five felony charges, one of which was added Sunday.
The suspect, Evan Tyler, is accused of fatally killing 17-year-old Dylan Peters at Peters’ home in the Whispering Winds neighborhood off Hampton Highway.
On Monday, he waived his preliminary hearing on charges of second-degree murder, attempted robbery, use of a firearm in the commission of a felony, shooting into an occupied dwelling and a newly added charge of attempted statutory burglary armed with a deadly weapon.
“Donna [Maw, York-Poquoson Deputy Commonwealth’s Attorney] and I went out to the murder scene to talk with [Peters’] stepdad, who was actually in the home when all this happened, and he was going to be one of our witnesses at the preliminary [hearing],” Commonwealth’s Attorney Ben Hahn said. “In speaking with him and being there and seeing the scene, it became obvious to us that another charge must be placed.”
Police say Tyler wanted to rob Peters of marijuana the afternoon of Jan. 27. They believe he took a gun with him to Peters’ home on Cattail Lane and shot five .40 caliber bullets through the half-open door and into Peters’ chest, shoulder, leg and hand.
Peters died at the hospital shortly after the shooting.
Two other people — Tevin DeSean Lambert and Alphonzo Christopher Jackson — have also been arrested in connection with the shooting.
Lambert faces felony armed robbery, felony conspiracy to commit robbery and felony use of a firearm in the commission of a felony and has a preliminary hearing in York-Poquoson Juvenile and Domestic Relations Court at 10 a.m. July 16.
Jackson faces felony counts of accessory to murder, accessory to robbery and conspiracy to commit robberyface . His preliminary hearing is scheduled for 10:30 a.m. July 23 in the same court.
If a grand jury decides there is enough evidence against Tyler, it will move the case to be tried in York-Poquoson Circuit Court.
Under Virginia statute, Tyler must be tried as an adult given the severity of the charges.
