Brothers Charged with Destruction of Property at Shell Gas Station

Two brothers were arrested after James City County police say they damaged property at the Shell gas station on Monticello Avenue after attempting to find someone to purchase alcohol for them.

Employees at the Shell gas station told police that around 10:40 p.m. Aug. 13 New Jersey residents David and Osbaldo Jimenez, 18 and 19, respectively, were looking for someone to purchase alcohol for them when management went outside to confront them.

Deputy Chief Steve Rubino said the brothers became upset and began damaging Shell property, including a wooden bench, signs and banners, and tipped over liquid waste barrels.

The Jimenez brothers were accompanied by two 15-year-olds. Rubino said the four of them ran on foot after the two brothers destroyed property, and police found them a short time later near the Powhatan Plantation resort.

The brothers indicated they had gone to the Shell gas station with the two 15-year-olds they had met who are also from New Jersey, and admitted to police they were trying to get alcohol purchased for them. Rubino said the brothers were already under the influence of alcohol.

The property they allegedly destroyed is worth $1,000, Rubino said. Osbaldo Jimenez is charged with one felony count of property destruction and misdemeanor counts of contributing to the deliquency of a minor, providing false identification, illegal possession of alcohol and attempted purchase of alcohol. David Jimenez is charged with four of the same charges, with no charge of false identification.

The two 15-year-old boys were not charged and were released to their parents, Rubino said. No one was injured during the incident.
