York-Poquoson Sheriff J.D. “Danny” Diggs and Chad Green, chairman of the York County Board of Supervisors, were on the Tucker Carlson Tonight show on Fox News Wednesday night.

The segment had to do with the new gun bill and both men talked about York County becoming a constitutional county.

Diggs told Carlson he feels the banning of “assault firearms” is excessive because it turns law abiding citizens into criminals for no good reason.

Instead, he thinks there should be consequences for people who use guns during a commission of a crime, similar to Project Exile in Richmond in the 1990s.

“If you want to have an impact on people committing crimes with guns, you need to be serious about guns,” Diggs said.

He said he feels people, in this case Democratic lawmakers, are clueless about how firearms function and that limiting the size of magazines does not make sense.

State Democratic lawmakers are advancing legislation to ban the sale of assault weapons and the possession of high-capacity magazines. The state House voted 51-48 Tuesday to pass the legislation to prohibit the sale of certain semiautomatic firearms, including popular AR-15 style rifles, and ban the possession of magazines that hold more than 12 rounds. The legislation now moves to the Senate, where moderate Democrats have indicated they are unlikely to support the measure. Heated debates over guns have dominated this year’s legislative session, as Virginia has become ground zero in the nation’s raging debate over gun control and mass shootings.

Diggs compared the restricting on ammunition to limiting the horsepower or capping the speed limit on cars to avoid crashes.

“That’s essentially what they are doing with guns,” he said. “If I’m going to shoot someone or commit a crime, do you think I’m concerned I might use a magazine that has more rounds?”

Diggs, like Green, support the U.S. Constitution and and said they feel the 2nd Amendment should not be infringed as these rights were given to citizens by the founders.

“We’re going to do all we can to protect our rights,” Diggs said.

Overall, Diggs said he feels the bill is too convoluted and “wordy” since the term assault weapons now includes rifles and pistols and firearms would be restricted to the household and not be allowed to be transported.

He believes the bill will be struck down.

Green, who crafted the constitutional county resolution, said the document is not only legal and binding but it is valid and enforceable.

“If you have 12 rounds of ammo you are a felon,” he said of the bill, noting it also bans certain types of guns. “That’s just not right.”

“We all want to keep the guns out of the hands of criminals and the mentally unbalanced,” he added. “We have enough gun legislation ––– I think we need to enforce what is out there.”

Green said he has received overwhelming support from the people of York County and he wants to see legislation that curbs gun violence.
