Case against accused Farm Fresh shooter to go to grand jury

The case against a man accused of killing a stranger in a Norge Farm Fresh will go straight to a grand jury.

Brian Alexander Hicks, 55, of Woodbridge, is charged with second-degree murder and use of a firearm in the commission of a felony in connection with the April 17 shooting death of Gabriel Ryan Maness, 34.

Police believe Hicks shot Maness multiple times inside the store, located at the 115 Norge Lane. When police arrived on the scene, Hicks was standing about five feet away from Maness’ body with a .45-caliber handgun on the floor.

Hicks waived his right to a preliminary hearing in Williamsburg-James City County General District Court on Thursday, said Commonwealth’s Attorney Nate Green.

At a preliminary hearing the prosecution must prove there is enough evidence against someone to charge them with a crime, according to the United States Department of Justice.

Similarly, a grand jury will decide if there is probable cause to take Hicks case to circuit court on Sept. 20.
