The chairman of the state Board of Elections tweeted that the board will draw the name of the winner of the 94th House of Delegates election on Jan. 4, unless a three-judge panel on makes a decision on the case first.
James Alcorn announced on Twitter that the State Board of Elections will meet at 11 a.m. that day to pick a winner of the race between Del. David Yancey and Shelly Simonds.
There have been no updates on the race on the State Board of Elections website, nor has it released a statement.
A spokeswoman with the Department of Elections did not immediately respond to a request for comment.
Friday morning, lawyers for Yancey sent a letter to the board asking them to schedule a meeting, after the board postponed its Dec. 27 meeting just one day before it was scheduled to convene.
