
A 17-year-old York County boy accused of fatally shooting a Tabb High School student had a date for his trial scheduled Tuesday.
Evan Tyler is charged with second-degree murder, attempted robbery, use of a firearm in the commission of a felony, shooting into an occupied dwelling and attempted statutory burglary while armed with a deadly weapon.
Tyler appeared before the court Tuesday to have a date for his trial set, which is now scheduled for March 29 at 1 p.m. The trial date was scheduled after a mental health evaluation ruled he was competent to stand trial.
Shawn Overby, Tyler’s defense attorney, stated during Tuesday’s hearing that he anticipates the March 29 hearing will take 30 to 45 minutes.
The charges stem from an incident that occurred in the Whispering Winds neighborhood in January 2015 during which Tyler attempted to rob Dylan Peters, also 17, of marijuana, court documents show.
Police said Tyler took a gun with him to Peters’ home and shot five .40 caliber bullets through a half open door while Peters was on the other side, killing him.
When Tyler last appeared in York-Poqouson Circuit Court, Overby requested Judge Richard Rizk order his client to undergo a mental health evaluation to determine both his sanity at the time of the incident and his competency to stand trial now.
Rizk granted the request and the competency evaluation found Tyler is fit to stand trial. The results of the sanity evaluation were disclosed to Overby; it is the prerogative of the defense to decide whether or not they will use those results as part of the case.
