Effective January 1, 2025, Virginia’s motor vehicle liability insurance coverage limits have increased, impacting policies issued or renewed on or after this date. The changes reflect the second phase of legislative amendments passed in 2021, aimed at providing greater financial protection for motorists involved in accidents.
What the New Minimum Insurance Coverage Means for Virginia Drivers
Under the updated law:
- The minimum liability coverage for bodily injury or death has increased from $30,000 to $50,000 per person.
- Coverage for bodily injury or death of two or more people in one accident has risen from $60,000 to $100,000.
- Property damage liability now requires a minimum of $25,000, up from $20,000.
These changes are designed to align Virginia’s minimum coverage requirements with the rising costs associated with automobile accidents. However, even with the increased limits, minimum coverage often falls short of fully covering the costs of severe accidents.
Why These Changes Matter
According to the National Safety Council, the average cost of an auto accident can be staggering:
- $1,869,000 per death
- $162,000 per disabling injury
- $42,000 per evident injury, such as broken bones or spinal damage
- $26,000 per possible injury, such as concussions or whiplash
- $6,100 for accidents involving only property damage
“Many drivers carry only the bare minimum insurance or, worse, no insurance at all, despite Virginia law requiring coverage,” says Brad Huffman, senior partner attorney at Huffman & Huffman Brothers-in-Law, a Virginia-based personal injury law firm. “We regularly see clients facing devastating financial impacts because the at-fault driver is either uninsured or underinsured. Ensuring you have adequate coverage, including Uninsured/Underinsured Motorist (UM/UIM) protection, is critical.” The attorneys at Huffman & Huffman strongly recommend carrying at least $100,000 in liability coverage to better protect yourself in the event of an accident. Even with the increased minimum limits, the cost of severe injuries or property damage can far exceed those amounts, leaving drivers financially vulnerable. Virginia law mandates that all auto insurance policies include UM/UIM coverage, which protects you if the at-fault driver lacks sufficient insurance. As of January 2025, UM/UIM limits will mirror the updated liability coverage minimums.
How This Affects Your Premiums
Drivers who already carry insurance above the new minimums are unlikely to see significant increases in their monthly premiums. For those at the minimum level, the adjustment offers better protection in the event of an accident, reducing potential out-of-pocket liability.
